Trust & Estate Tax
Trust & Estate Tax
Tax return preparation and related tax advice for estates, trusts, fiduciaries and beneficiaries, including Forms 1041, 541 and 706.
Fiduciary Income Tax Returns
An estate or trust may have filing and beneficiary-reporting obligations that are separate from the decedent’s final individual income tax return. The required filings depend on the governing documents, the assets and income involved, the timing of distributions, and applicable federal and state law.
Income-tax filings
- Federal Form 1041 for estates and trusts
- California Form 541 fiduciary returns
- Schedule K-1 reporting for beneficiaries
- Final Form 1040 for a decedent
- Extensions, estimated payments and related filings
Common fiduciary matters
- Income earned during estate administration
- Interest, dividends, rent and capital gains
- Distributions to beneficiaries
- A revocable trust becoming irrevocable after death
- Allocation of income and deductions between the fiduciary and beneficiaries
Estate Tax Returns and Portability
The firm also prepares federal Form 706 estate tax returns, including portability elections when applicable. The need for a filing depends on the estate, prior taxable gifts, available exclusions, elections and other facts.
Because estate-tax filings involve asset values, ownership records and legal documents, the tax work may require coordination with the executor, trustee, estate attorney, appraisers and financial advisors.
Fiduciaries, Beneficiaries and Coordinated Advice
Assistance may include reviewing the tax treatment of income, deductions and distributions; identifying filing deadlines; preparing beneficiary reporting; and explaining how the fiduciary return relates to each beneficiary’s individual return.
This service is limited to tax compliance and tax advice. James does not draft wills or trust documents or provide probate legal services. When legal work is required, the tax engagement can be coordinated with the client’s estate attorney.
